General Terms and Conditions
HIX Publishing offers paid information services that are sent by email. For each information service a total of 40 issues are sent out each year. These are usually sent out weekly, except during holiday periods, major events such as trade fairs, or in the event of illness or technical problems.
HIX Publishing also offers paid market studies, which are delivered exclusively in digital form, either by email or as a download.

- General information
1) The following terms and conditions apply exclusively to all deliveries and services provided by the user.
2) All product names are the property of their respective manufacturers. Product images are in some cases illustrative and may differ from the products ordered/delivered.
3) The buyer’s terms and conditions of purchase are only valid if they have been specifically agreed and confirmed in writing by the user. Purchase contracts are only concluded upon written acceptance of the order (order confirmation) or upon acceptance of the goods by the customer, if applicable only after expiry of the cancellation/return period. An unsigned email is sufficient to satisfy the written form requirement.
- Delivery and reservation of delivery / Terms and conditions of purchase
1) HIX Publishing offers paid information services that are sent by email. Forty issues of each information service/newsletter are sent out each year. These are usually sent out weekly, except during holiday periods, major events such as trade fairs, illness, technical problems or force majeure.
2) Claims for damages are excluded unless there is gross negligence or intent on the part of the seller. If a particular item or replacement item is not available, the seller is entitled to refuse delivery. The seller will inform the buyer immediately of the lack of availability and, if payment has already been made, refund the money.
3) Terms and conditions for subscriptions: With a single subscription, five readers from the ordering company are entitled to receive the ordered information service. If several people from the ordering company wish to read the information service, it is possible to purchase a group subscription at twice the price of a single subscription.
4) In the case of market studies, only employees of the ordering company may use the study. It may not be passed on to other parts of the company, e.g. abroad, or to other companies in the same group of companies. If a group of companies wish to work with the study, a group licence for the study can be purchased at twice the price of the study.
- Ordering / Cancellation / Subscription renewal
1) Subscription orders can be placed at any time. Orders must be placed in writing, either using the form provided on the website, the HIX Publishing order form or by email. Once HIX Publishing has received the order, the customer will receive a confirmation and an invoice.
2) Orders for market studies must be placed in writing, either using the form provided on the website, the HIX Publishing order form or by email. Once the order has been received by HIX Publishing, the customer will receive confirmation and an invoice if the market study is available. If it is not available, no longer available or not yet available, the customer will receive a corresponding reply. The delivery contract is only concluded if the market study is available.
3) Subscriptions must be cancelled six weeks before expiry. Otherwise, they will be automatically renewed for another year.
- Prices
1) All prices quoted by the seller on its website are exclusive of VAT. In the Federal Republic of Germany, prices are subject to statutory VAT.
2) The prices valid at the time of ordering shall always apply.
3) For orders of market studies from companies outside the Federal Republic of Germany, payment in advance is required. Only after receipt of payment will the ordered digital study be sent by email or download code to the email address specified in the order.
- Right of return
Digital market studies: As digital market studies are downloadable products, they are non-returnable.
Subscribed information services: A two-week right of return applies here. The two-week period begins upon receipt of the first information service included in the subscription.
- Terms of payment
1) All subscriptions are subject to a payment term of two weeks without discount, unless other payment terms have been agreed with the buyer.
2) Market studies in Germany are subject to a payment term of two weeks without discount.
3) Customers based outside the Federal Republic of Germany can only be supplied with market studies if they pay in advance (without discount).
4) If the buyer defaults on payment, a fee of €5 will be charged for each reminder, as well as default interest of 5% (8% if the customer is an entrepreneur, a legal entity under public law or a special fund under public law) above the respective base interest rate announced by the Deutsche Bundesbank.
- Data protection
1) The data required for processing the order will be stored and treated confidentially in accordance with the provisions of the Data Protection Act.
2) However, the seller reserves the right to transfer data for the purpose of credit checks. The buyer is entitled to revoke this at any time.
- Place of performance
The place of performance for all obligations arising from the contractual relationship, including any warranty claims, shall be the registered office of the seller.
- Place of jurisdiction
If the buyer is an entrepreneur or a legal entity under public law or a special fund under public law, the place of jurisdiction shall be the registered office of the seller.
- Other provisions
The invalidity of individual provisions of the underlying contract, including the General Terms and Conditions, shall not affect the validity of the remaining provisions.
Declarations of any kind concerning the contractual relationship between the seller and the buyer must be made in writing to be valid, unless otherwise agreed in writing. The written form is required in particular for the waiver of the written form requirement.
Verbal agreements shall only be valid if they are confirmed in writing without delay. If this confirmation is not provided, the verbal agreement shall be deemed not to have been made.
